1. Agreement to Terms

By accessing or using Bomps ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you do not have permission to access the Service.

2. Description of Service

Bomps is a business management platform providing scheduling, customer management, invoicing, and related business tools for service-based businesses.

3. Account Registration

To use the Service, you must:

Be at least 18 years old
Provide accurate and complete registration information
Maintain the security of your account credentials
Accept responsibility for all activities under your account

4. Subscription and Payment

4.1 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. All fees are exclusive of applicable taxes.

4.2 Automatic Renewal

Subscriptions automatically renew unless cancelled before the renewal date.

4.3 Refunds

Monthly subscriptions are non-refundable. Annual subscriptions may be refunded within 14 days of purchase if you have not substantially used the Service.

5. Acceptable Use

You agree not to:

Use the Service for any illegal purpose
Violate any applicable laws or regulations
Infringe on the rights of others
Attempt to gain unauthorized access to any part of the Service
Interfere with or disrupt the Service
Use the Service to send spam or unsolicited communications

6. Your Data

You retain all rights to your business data. You grant Bomps a limited license to process your data solely to provide and improve the Service.

7. Intellectual Property

The Service and its original content (excluding your data) remain the property of Bomps GmbH. Our trademarks may not be used without prior written consent.

8. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted access. Scheduled maintenance will be announced in advance when possible.

9. Limitation of Liability

To the maximum extent permitted by law, Bomps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Bomps and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the Service will cease immediately.

You may export your data before termination. We retain your data for 30 days after termination to allow recovery, then permanently delete it.

12. Governing Law

These Terms shall be governed by the laws of Germany. Any disputes shall be resolved in the courts of Berlin, Germany.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide 30 days notice for material changes. Continued use of the Service after changes constitutes acceptance of the new Terms.
